However, the RFU Disciplinary Officer, His Honour Judge Jeff Blackett, has reviewed the matter and Azam has now been summoned to attend a new hearing at the Coventry Holiday Inn on Thursday May 7 (7.30pm).
He has been charged with conduct prejudicial to the interests to the Union and/or the Game contrary to Rule 5.12 in that he made contact with the eyes or eye area of Roberts.
The panel will comprise Antony Davies (Chairman), John Brennan and Bob Taylor.
Gloucester Rugby will not be making any further comment ahead of the hearing.
